(CLASI) has seen time and time again that businesses and even government sites fail when it comes to ADA parking compliance. For example, DRD\u2019s most recent <\/span><a href=\"https:\/\/www.declasi.org\/wp-content\/uploads\/2025\/06\/DRD-2024-General-Election-Accessibility-Report.pdf\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">poll monitoring report<\/span><\/a><span data-contrast=\"auto\"> found that <\/span><a href=\"https:\/\/www.declasi.org\/es\/disability-rights-delaware-report-finds-widespread-ada-parking-accessibility-violations-at-polling-places\/\" target=\"_blank\" rel=\"noopener\"><span data-contrast=\"none\">54% of polling places<\/span><\/a><span data-contrast=\"auto\"> were not fully ADA compliant.<\/span><\/p>\n<p><b><span data-contrast=\"auto\">\u201cFor years it has been on the backs of people with disabilities to file complaints to get noncompliant parking fixed,\u201d<\/span><\/b><span data-contrast=\"auto\"> says DRD Project Director Marissa Band. <strong>\u201c<\/strong><\/span><b><span data-contrast=\"auto\">HS 2 for HB 48 creates an upstream intervention&#8211;<\/span><\/b><b><span data-contrast=\"auto\">addressing the problem before it is even an issue<\/span><\/b><span data-contrast=\"auto\">, by creating a permitting process to ensure that parking is accessible when built or modified.\u201d\u00a0 <\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">HS 2 for HB 48 requires that a permit be issued by the local county or municipal authority to ensure that accessible parking spaces are compliant with the design and construction requirements of the ADA, and allows for a civil penalty of up to $500 on an individual or entity that does not construct and maintain ADA compliant parking spaces. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The bill also increases the fine for unlawfully occupying an accessible parking space, it and removes as a defense a spot\u2019s technical noncompliance with the ADA, so long as the spot is clearly marked as accessible.\u00a0 <\/span><b><span data-contrast=\"auto\">Both the House and Senate have now passed the bill; it awaits Governor Matt Meyer\u2019s action<\/span><\/b><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">DRD thanks Representative DeShanna Neal, Senator Nicole Poore, Lt.
