The guide,\u00a0<em><a href=\"https:\/\/www.declasi.org\/wp-content\/uploads\/2026\/09\/Delaware-Avenues-of-Release-Guide-9-30-2026.pdf\" data-type=\"link\" data-id=\"https:\/\/www.declasi.org\/wp-content\/uploads\/2026\/09\/Delaware-Avenues-of-Release-Guide-9-30-2026.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Delaware Avenues of Release: Commutation, Compassionate Release, &amp; Medical Parole<\/a>,<\/em>\u00a0outlines\u00a0recent significant changes to Delaware law related to early release from prison and the\u00a0pathways that are now available.\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-left wp-block-paragraph\">In July 2025, Delaware passed a new law that changes how people in prison can ask for early release. <a href=\"https:\/\/legis.delaware.gov\/BillDetail\/142344\" target=\"_blank\" rel=\"noopener\">Senate Bill 10<\/a>, also known as the Richard \u201cMouse\u201d Smith Compassionate Release Act (\u201cSB10\u201d), is named for a longtime Delaware NAACP leader and civil rights advocate, Richard \u201cMouse\u201d Smith, who passed away earlier in 2025. The law took effect on January 10, 2026, six months after it was signed by Governor Matt Meyer. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SB10 rewrote Delaware\u2019s previous main compassionate release law, expanding the eligibility criteria for release including pathways based&nbsp;on serious medical illness, age, and&nbsp;time served. The law&nbsp;also&nbsp;removes the Board of Parole from the&nbsp;compassionate release process,&nbsp;allows incarcerated individuals to apply directly to the&nbsp;court even if the prison system has not recommended them for&nbsp;release, and provides the right to a lawyer.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Delaware&nbsp;currently has three separate ways that someone can be released early: 1) compassionate release; 2) medical parole; and 3) commutation. \u201cThese options overlap in ways that can be confusing,\u201d said DRD Staff Attorney Caroline Szerenyi. \u201cThis guide&nbsp;is meant to explain how the three distinct avenues of release operate in Delaware, to give the community a clearer understanding of the options.\u201d &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because SB10 is so new, court rulings and&nbsp;guidance&nbsp;on how the law&nbsp;will work in practice are limited; this guide focuses on the clear changes made in the letter of the law itself.&nbsp; \u201cOur goal is to inform incarcerated Delawareans with disabilities, and their families, of the changes in the law and options available, so that people with disabilities, including serious illness, can exercise their legal rights,\u201d added DRD Project Director Marissa Band.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Access the full guide <a href=\"https:\/\/www.declasi.org\/wp-content\/uploads\/2026\/09\/Delaware-Avenues-of-Release-Guide-9-30-2026.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>.<\/strong>\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\">###&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>About Community Legal Aid Society, Inc.
