Housing Unit

The Housing Unit helps people with low incomes who are facing eviction, housing instability, loss of housing subsidies, or unsafe housing conditions. We also work to strengthen tenants’ rights and address the shortage of safe, affordable housing in Delaware.
Through our Fair Housing Program, we also fight discrimination in housing transactions. We assist people who believe their rights have been violated under federal and state fair housing laws through advocacy and enforcement actions, and we encourage fair housing practices through testing, education, training, and outreach.
Our Services
We provide free legal assistance to tenants living in subsidized housing, meaning the rent is based on income, including Section 8 housing (project-based and vouchers), public housing, low-income housing, and tax credit housing. We assist subsidized tenants with the following matters:
- Eviction
- Lockout
- Termination of housing subsidies
- Unsafe living conditions
We also provide free assistance to people who believe they have been victims of discrimination in housing transactions, including renting, buying, or applying for a mortgage, based on their:
- Race
- Color
- National origin
- Religion
- Creed
- Sex (including sexual orientation and gender identity)
- Marital status
- Age
- Disability
- Source of income (such as a housing voucher)

Significant Cases and Impact Litigation
Kravis v. Justice of the Peace Court 17 and MHC McNicol Place, LLC – victory on behalf of an elderly tenant with disabilities, in a collaborative effort by CLASI’s Elder Law and Fair Housing Programs, where the Delaware Supreme Court ruled that under state and federal fair housing laws, tenants with disabilities can request a reasonable accommodation from a landlord at any time prior to eviction.
